Terms & Conditions
Welcome to XPixel Media.
These Terms & Conditions govern your access to and use of the XPixel Media website, https://xpixelmedia.com/, and provide general terms relating to the digital marketing and related services offered by XPixel Media.
In these Terms, “XPixel Media”, “we”, “us”, and “our” refer to XPixel Media, based in Delhi, India.
By using this website, you agree to these Terms & Conditions. If you do not agree with these Terms, please do not use the website.
1. About XPixel Media
XPixel Media is an independent digital marketing business providing services that may include:
- Search Engine Optimization (SEO)
- Social Media Marketing
- Performance Marketing
- Google Ads
- Meta Ads
- Content Writing and Content Marketing
- Website Designing
- Other related digital marketing services
The specific services, deliverables, pricing, timelines, and responsibilities applicable to a client will depend on the service agreed upon between the parties.
2. Website Use
You may use this website for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the website for unlawful or fraudulent purposes
- Attempt to gain unauthorised access to the website or its systems
- Interfere with website operation or security
- Introduce malicious code, viruses, or harmful material
- Copy or reproduce website material without permission
- Use website content in a way that infringes our rights or the rights of others
We reserve the right to restrict or terminate access to the website where reasonably necessary to protect the website, our business, or other users.
3. Website Content
We make reasonable efforts to provide useful and accurate information on our website.
However, website content is provided for general informational purposes and may change over time.
Service descriptions, pricing, examples, illustrations, and other website information should not automatically be interpreted as a binding offer unless expressly stated otherwise.
4. SEO and Digital Marketing Results
Digital marketing performance depends on many factors, including competition, industry conditions, customer behaviour, search-engine algorithms, advertising platforms, website quality, market demand, budget, content, implementation, and factors outside our direct control.
Accordingly:
XPixel Media does not guarantee specific Google rankings, traffic levels, leads, sales, revenue, advertising results, or other particular marketing outcomes unless a specific commitment is expressly included in a separate written agreement.
For SEO services in particular, no responsible agency can guarantee that a website will achieve or maintain a specific ranking position.
SEO and digital marketing should be understood as ongoing processes rather than guaranteed outcomes.
5. Service Engagements
Before work begins, the scope of the relevant service may be agreed through a proposal, quotation, service agreement, written communication, or another mutually accepted arrangement.
The applicable agreement may specify:
- Services included
- Deliverables
- Fees
- Billing arrangements
- Project or monthly scope
- Client responsibilities
- Timelines
- Minimum commitment period
- Other commercial conditions
Where a separate written agreement exists, its specific terms may take priority over general information published on this website.
6. Minimum Commitment
Our services may involve a minimum commitment period.
For ongoing SEO and other monthly services, the standard minimum commitment is three months unless a different arrangement is agreed in writing before the engagement begins.
The applicable proposal, quotation, service agreement, or written commercial arrangement will determine the precise billing and termination terms for the engagement.
7. Monthly Services and Billing
Where services are provided on a monthly basis, fees are generally payable according to the billing schedule agreed before the service begins.
The specific fee, billing date, payment method, and scope will be communicated to the client before or at the start of the engagement.
We reserve the right to suspend ongoing work where an agreed payment remains overdue, subject to any applicable agreement between the parties.
8. Refunds and Cancellations
Unless a separate written agreement states otherwise, payments for services are subject to the commercial terms agreed between XPixel Media and the client.
Because digital marketing work may involve planning, research, strategy, content, optimisation, campaign preparation, implementation, and other work performed specifically for a client, refunds are not automatically available simply because a client changes their mind after work has commenced.
Any refund or adjustment will be considered according to the applicable agreement, the work already performed, amounts already due, and other relevant circumstances.
Cancellation of a service does not automatically cancel amounts that have already become payable.
Where a minimum three-month commitment applies, cancellation terms will be governed by the applicable agreement.
9. Client Responsibilities
Clients are responsible for providing accurate and timely information and reasonable cooperation necessary for us to perform the agreed services.
Depending on the service, this may include:
- Providing accurate business information
- Providing website or platform access where required
- Providing relevant assets, content, images, or brand materials
- Reviewing and approving content where required
- Providing necessary advertising or business information
- Responding to reasonable requests within an appropriate timeframe
Delays caused by missing information, approvals, access, materials, or client-side actions may affect delivery timelines.
10. Third-Party Platforms
Digital marketing services may involve third-party platforms such as Google, Meta, WordPress, hosting providers, search engines, advertising platforms, social media platforms, analytics services, and other external technologies.
XPixel Media does not control the policies, algorithms, availability, pricing, technical changes, account decisions, or performance of third-party platforms.
Changes made by those platforms may affect campaigns, rankings, functionality, traffic, reach, or results.
We will make reasonable professional efforts within the agreed scope, but we cannot be responsible for changes or actions taken independently by third-party platforms.
11. Search Engine and Advertising Platform Changes
Search engines and advertising platforms regularly update their systems, algorithms, policies, interfaces, and requirements.
Such changes may affect rankings, visibility, traffic, advertisements, targeting, approvals, costs, or campaign performance.
XPixel Media may adjust strategies and implementation to respond to relevant changes, but we cannot guarantee that a platform change will not affect an existing campaign or SEO strategy.
12. Intellectual Property
Unless otherwise agreed in writing, the XPixel Media website and its original content, branding, graphics, design elements, written materials, layouts, and other intellectual property belong to XPixel Media or are used with appropriate permission.
You may not reproduce, republish, copy, distribute, modify, commercially exploit, or create derivative works from our website content without prior written permission, except where permitted by applicable law.
Client-owned materials remain the property of the client or their respective owner.
Ownership and usage rights relating to content, creative assets, websites, campaigns, and other work produced specifically for a client will depend on the terms agreed for that particular engagement.
13. Portfolio and Examples
Where we display client-related work, examples, case studies, results, or references, we will use them only where we have the appropriate permission or where the material is otherwise lawfully available for that purpose.
Results shown in examples should not be interpreted as a promise that another client will achieve identical results.
14. Third-Party Links
Our website may contain links to third-party websites or services for informational or practical purposes.
We do not control or endorse all third-party websites and are not responsible for their content, security, availability, policies, or practices.
Your use of any third-party service is governed by that service’s own terms and policies.

This may include losses arising from third-party platform changes, search-engine changes, advertising-platform decisions, website downtime, internet failures, cyber incidents, or other circumstances beyond our reasonable control.
Nothing in these Terms is intended to exclude or restrict any liability that cannot legally be excluded or restricted under applicable law.
17. Force Majeure
XPixel Media will not be responsible for delays or failure to perform caused by circumstances beyond reasonable control.
Such circumstances may include major internet or infrastructure failures, natural disasters, government actions, widespread platform outages, cyber incidents, war, civil disturbance, or other events that could not reasonably be prevented or controlled.
18. Suspension or Termination of Services
We may suspend or terminate services where reasonably necessary, including in circumstances involving:
- Non-payment
- Material breach of an agreement
